Article 1 (Application of Terms of Service) |
“L’OSIER Website” (below, “the Website”) is a site administered by Shiseido Parlour Company, Limited and Shiseido Company, Limited (below collectively referred to as , “the Company”).
L’OSIER Website Terms of Service (below, “the Terms of Service”) prescribe basic matters concerning the use of various services (below, “the services”) provided to either members or nonmembers through the Website.
The Terms of Service apply to all users and members who use the Website services (below collectively referred to as “users”). |
Article 2 (Definitions of users and members) |
Regardless of whether the Company can identify individual users, all persons using the services are deemed to be users. |
Article 3 (Consent to Terms of Service) |
When a user has actually used the services, they are deemed to have consented to the Terms of Service. |
Article 4 (Devices etc. required for use of services) |
Users are responsible for devices, communications equipment, software, and other equipment (communications charges) etc. required to receive the services. |
Article 5 (Notification / alteration of Terms of Service) |
The Company may voluntarily alter all or part of the Terms of Service without notifying users in advance. In such a case, the Company will issue a notification of the alterations through the Website, and the alterations will take effect as soon as the notification is posted on the Website. |
Article 6 (Prohibited conduct) |
The Company prohibits users from engaging in (including encouraging or preparing to engage in) the following conduct during their use of the Website:
- (1) Conduct such as slander or defamation that damages or could damage the honor of other users, third parties, or the Company (including other companies related to the Company)
- (2) Conduct that infringes or could infringe the property rights or privacy of others users, third parties, or the Company (including other companies related to the Company)
- (3) Conduct that infringes or could infringe the intellectual property rights (copyrights, design rights, patents, utility model rights, trademark rights, and rights to one’s likeness) of other users, third parties, or the Company (including other companies related to the Company)
- (4) Transmitting or sending harmful computer programs etc.
- (5) Conduct that goes against public order and morals, criminal conduct, or conduct that could be considered as such
- (6) Using or preparing to use the services for business purposes
- (7) Electioneering activities or similar and other conduct relating to politics or religion
- (8) Other conduct that obstructs provision of the services
- (9) Using the services with the ID of another member
- (10) Obtaining, disclosing, or supplying the IDs or passwords of other users, regardless of the method employed
- (11) Conduct that violates laws or regulations in Japan or the country/territory in which the user resides

Article 7 (Responsibility for use of information supplied through the Website) |
The Company does not guarantee the integrity, usefulness, etc. of information users obtain through the Website, such as information posted by other users. Moreover, users are personally responsible for their decision to use the Website, and the Company assumes no liability for any outcomes resulting from users using or trusting this information etc. |
Article 8 (Copyrights and other intellectual property rights) |
- Rights to all the information carried on the Website resides with the Company or is used by the Company under license or other legitimate rights, and users are prohibited from using any of the information carried on the Website for purposes other than their own personal use, resupplying it to the public either inside or outside the network, or use, reproduction, etc. of it without permission.
- All the trademarks and service marks appearing on the Website belong to the Company or other companies related to the Company, or are used under license or other legitimate rights, and the Company prohibits users from using them without permission.
- If copyrights (including rights prescribed in Article 27 and Article 28 of the Copyright Act) or other intellectual property rights arise with respect to information etc. supplied by users, the users concerned shall transfer the rights to the information etc. to the Company free of charge and shall not exercise rights such as their moral rights as the authors.

Article 9 (Changes in, additions to, or termination of services) |

In any of the following circumstances, the Company may temporarily suspend or permanently terminate provision of all or some of the services without notifying users in advance.
- (1) When performing periodic or urgent maintenance, testing, etc. of the system that provides the services
- (2) When a malfunction etc. has occurred with the system that provides the services
- (3) When it is difficult to provide the services due to a power outage, fire, earthquake, or other force majeure
- (4) When there is another legitimate operational or technical reason that the services cannot be provided
- The Company may change, make additions to, or terminate all or some of the services without advance notification.
- Even if the measures described above cause users to be inconvenienced or incur losses, the Company will not assume any liability.

Article 10 (Third-party websites) |
The Company assumes no liability for losses resulting from the use of websites managed/administered by third parties to which links are posted on the Website, and has no obligation to provide compensation for such losses. |
Article 11 (Handling of personal information) |
- Customers will generally not be required to provide information, such as their names and addresses that could be used to identify them when they access and browse the Website.
- Customers only need to provide personal information to the Company when they use the following services on the Website. Although the following services are offered free of charge, the customer is responsible for the communications charges and provider fees incurred in accessing the Website.
- (1) When the customer makes a reservation for the Company’s restaurant from the Website.

Article 12 (Waivers and compensation for losses) |
- If a user has caused the Company to suffer a loss as a result of violating the Terms of Service or improper conduct, the Company may demand compensation equivalent to the loss from the user concerned. Moreover, if a user has caused a third party to suffer a loss as a result of using the services, the user will be responsible for resolving the issue themselves.
- Unless otherwise explicitly stated in the Terms of Service, the Company assumes no liability to users or third parties for malfunctions/failures of the system that provides the service, incursion into the system by third parties, commercial disputes, etc. that have occurred as a result of use of the services.

The Website protects the personal information of customers by employing highly secure technologies and maintaining a high level of security.
- Unauthorized access is prevented using a firewall.
- Unauthorized access is prevented through the periodic analysis of access logs and the deployment of an incursion detection system.

- Users are free to post links to the Website. However, links may not be posted on websites containing the following content:
- (1) Content that goes against public order and morals

- (4) Other content that can be objectively determined as harming the corporate value of the Company
- If a user posts a link, they should generally link to the homepage of the Website (URL: https://losier.shiseido.co.jp/e/). Users also accept in advance that the page they have linked to may be changed or removed without warning.
- The Company also assumes no liability for any inconvenience that arises from pages being relocated, deleted, etc.

Article 16 (Governing law and court of jurisdiction) |
The interpretation and application of the Website and the Terms of Service is based on Japanese law. Moreover, unless otherwise prescribed, the exclusive and mutually-agreed court of jurisdiction for the first hearing concerning all disputes pertaining to the Website is the Tokyo District Court. |
